DELBIG - TERMS OF SERVICE

These Terms of Service govern the use of services offered by Delbig. By using the Delbig platform, websites, applications or integrations, you accept these terms.
1. Parties and service provider
Within the scope of these terms of service, the service provider:

In these terms, the terms “Delbig”, “we”, “service provider” refer to the above company; The terms "user", "customer", "tenant", "business" or "you" refer to the natural or legal person using the service.
2. Scope
These terms apply to all software, CRM, integration, communication, management panel and support services offered by Delbig, especially https://delbig.com and https://app.delbig.com.
3. Nature of the service
Delbig; CRM is a software service that can offer functions such as customer management, quote and order processes, task management, contact records, email and third-party platform integrations.
Some features may depend on paid plans, technical availability, availability of third-party services, policies of platforms such as Meta/Google, or tenant-based configurations.
4. Account and access security
The user is responsible for the security of his account and the protection of his access information.
The user agrees to:
– Keeping login information confidential
– Not sharing account access with unauthorized persons
– Immediately report any unauthorized access, account breach or suspicious use to support@delbig.com
– Appropriately manage authorized users and employee access within its own tenant structure
5. Tenant and customer data
Delbig can serve with a multi-tenant structure. Each tenant/company is responsible for its own data, users, authorization configurations and usage purposes.
The user/tenant agrees to:
– He has the necessary right over the data he uploads, creates or connects to Delbig.
– It has the necessary legal basis in terms of customer data, communication content and integration records processed through Delbig.
– It is responsible for providing the necessary information and permissions for its own end users, customers and employees.
6. Acceptable use
The Service may only be used for lawful and legitimate business purposes.
The following behaviors are prohibited:
– Unauthorized access attempts
– Damage to systems, data or infrastructure
– Interruption or abuse of the service
– Sending spam, phishing, deceptive messages or illegal content
– Unauthorized access to data of other users, tenants or customers
– Using Delbig for illegal campaigns, fraud, misleading communications or harassment
– Use contrary to the policies and terms of third-party platforms
7. Third-party integrations
Delbig may integrate with third-party services such as Google, Meta, Facebook, WhatsApp Business Platform, SMTP providers, hosting services, payment services or similar.
In terms of these integrations:
– The relevant third parties' own terms and policies also apply
– Delbig is not directly responsible for any interruption, restriction, policy change or access blockage of a third party service.
– The user must have the necessary authorizations for the third-party accounts he/she integrates
8. Meta, Facebook and WhatsApp usage
If the user uses Meta, Facebook or WhatsApp Business Platform integrations via Delbig:
– Responsible for complying with relevant platform policies
– Bears the necessary legal responsibility for the messages, conversations, communication records and campaigns sent to its own customers.
– Responsible for providing the necessary approval, permission, information and legal basis
Delbig may limit, change or discontinue certain features due to changes resulting from technical, commercial or political restrictions imposed by Meta or WhatsApp.
9. Pricing and payment
Paid plans, subscriptions, additional usage fees or integration-related costs are determined by the scope of the relevant plan, offering or service.
Unless otherwise agreed in writing:
– Fees are collected in specified periods
– Service may be limited in case of delayed or unsuccessful payments
– Certain features may be suspended
– If overdue payments continue, the account may be frozen or access restricted
10. Service continuity and right to change
Delbig may make changes to the service, features, integrations, or interfaces to improve the service, increase security, ensure legal compliance, or adapt to third-party platform changes.
The service may be temporarily partially or completely interrupted due to planned maintenance, security updates, bug fixes, infrastructure changes or third-party outages.
11. Data, backup and storage
Delbig implements reasonable technical measures to protect data. However, the user is responsible for backing up his/her critical business data separately.
Even if Delbig is backing up:
– that every data will always be returned in full
– each version will be kept for an unlimited period of time
– data loss will not occur under any circumstances
does not guarantee.
12. Intellectual property
Intellectual property rights on the Delbig brand, design, interface, software, code, content, documentation and service components belong to Delbig or the relevant rights owners.
Without express written consent:
– cannot be copied
– cannot be reproduced
– cannot be rented
– cannot be licensed
– cannot be reverse engineered
– cannot be commercially redistributed
13. Privacy and data protection
Delbig's data processing activities are regulated under a separate Privacy Policy. By using the Service, you acknowledge that you have reviewed and understood the applicable Privacy Policy.
14. Suspension and termination
Delbig may suspend, limit or terminate the account or service in the following cases:
– Violation of these terms
– Suspicion of unlawful use
– Security risk
– Abuse, spam or platform policy violation
– Failure to fulfill payment obligations
– Mandatory restrictions from third-party platforms
The user may also request to close his account or terminate his use of the service.
15. Limitation of liability
The Service is provided “as is” and “as available” to the fullest extent permitted by law.
Delbig;
– uninterrupted operation,
– full suitability for every need,
– seamless compatibility with all third-party services,
– no data loss
does not give any express or implied warranty regarding its matters.
To the extent permitted by legislation, Delbig;
– indirect damages,
– loss of profit,
– job loss,
– loss of opportunity,
– data loss,
– loss of reputation,
– damages due to third-party platform restrictions
cannot be held responsible for its maintenance.
16. Liability for compensation
User; It agrees to be responsible for any claims, damages, expenses and defense expenses that Delbig may incur due to its own use, its own tenant data, its relationship with its customers, its own contents, its own integration preferences or third-party platform violations, to the extent permitted by the legislation.
17. Applicable law and authority
These terms are subject to the law of the Republic of Türkiye.
In case of disputes, BURSA courts and enforcement offices have jurisdiction, without prejudice to the otherwise mandatory legislative provisions.
18. Update of Terms
These terms may be updated from time to time. The current text is published on this page. Your continued use of the service may mean that you accept the updated terms.
